The LoanOutlet.ca Platform can be accessed directly via the website (www.loanoutlet.ca) or through the websites of our network of referral partners and affiliates (the “Referral Partners”). Through the Platform, LoanOutlet.ca provides a search engine that allows users to research and compare loan, mortgage, credit card, financial products, and other offerings from various Canadian lenders, credit card providers, credit monitoring services, and debt management solution providers (“Service Partners”). LoanOutlet.ca connects consumers with opportunities to improve their financial situation by working with a broad range of lenders and companies to offer new financing options. Additionally, LoanOutlet.ca supports business owners and sales professionals with a consumer portal, enabling companies to guide their clients through the financing application process for instant loan approvals to cover product or service costs.

 

2. Acceptance of Terms

You may not use the Platform or Services unless You agree to these Terms. By accessing or using the Platform and/or Services, You acknowledge that You have read, understood, and accepted these Terms. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE OR ACCESS THE PLATFORM OR ANY SERVICES PROVIDED THROUGH IT.

 

3. Updates to Terms

LoanOutlet.ca reserves the right to modify these Terms at any time, with modifications becoming effective immediately upon posting on the LoanOutlet.ca website or application. Your continued use of the Services and/or Platform signifies Your acceptance of any such changes.

7. The Service

The Platform and Services offer Users information and resources related to private and institutional financial services in Canada, enabling Users to research and compare financing products and services. The Service is free to use, and LoanOutlet.ca does not add any fees or commissions to the products or services displayed. LoanOutlet.ca is compensated by Service Partners, who pay fees and/or commissions. LoanOutlet.ca, its owners, officers, directors, agents, employees, and contractors are not licensed or qualified to provide mortgage or general financing services or advice in any way under Applicable Law.

 

8. No Endorsement

You acknowledge and understand that LoanOutlet.ca, its owners, officers, directors, agents, employees, and contractors do not endorse, recommend, or support any service, product, or resource available on or through the Platform. It is Your responsibility to assess the suitability, adequacy, and appropriateness of any product or service. The decision to obtain or refrain from obtaining any product or service is solely Yours. If You have doubts about the suitability or appropriateness of any product or service listed on the Platform, it is recommended that You seek independent professional advice before proceeding.

 

9. Using the Service

The Services provided by LoanOutlet.ca, its Referral Partners, or any third parties do not constitute an offer to sell any products or services to You. LoanOutlet.ca does not enter into any contractual agreements with You regarding any lender’s products or services. By submitting Your details, You are making an offer to obtain the relevant product or service from the applicable Service Partner, subject to their terms and conditions, which may be accepted or rejected. Service Partners may verify Your personal information, such as Your social insurance number, driver’s license number, provincial ID, or other government-issued identifications. They may also check federal databases, including but not limited to Equifax and TransUnion, to assess Your creditworthiness, credit standing, or credit capacity. By submitting Your application and information through the Platform, You consent to allow participating lenders to verify Your details and perform a credit check. All financing is contingent on employment status and income. Applicants must be at least 18 years old, and terms and conditions apply; guarantees and indemnities may be required by the Service Partner. For some products and services, LoanOutlet.ca may recommend conducting a credit check through a licensed credit-referencing agency. This credit check is optional and requires Your explicit consent. However, declining a credit check may limit the range and quality of products or services we can introduce to You. This credit check is considered a soft inquiry and will not negatively impact Your credit profile.

 

10. Intellectual Property Rights

LoanOutlet.ca grants You a limited, personal, non-exclusive, non-transferable license to access and use the Platform and Services for Your personal use only, and not for resale or further distribution. Your right to use the Platform and Services is subject to the terms and conditions outlined in these Terms.

 

Except for Your User Content, the following are the property of LoanOutlet.ca or its licensors and are protected by Canadian and international copyright laws: (a) the Services; (b) LoanOutlet.ca Content; (c) the Platform and all related software. All rights to the Services, Platform, and LoanOutlet.ca Content are expressly reserved. Trademarks, registered trademarks, product names, and logos mentioned in the Services or Platform are owned by their respective owners.

Unless explicitly allowed in these Terms, You shall not: (i) modify, improve, or create derivative works from the Platform; (ii) reverse engineer, decompile, or attempt to derive the source code, structure, or organization of the Platform; (iii) use automated software, programs, robots, web crawlers, spiders, data mining tools, or any other screen scraping technology; (iv) resell, transfer, distribute, market, or sublicense the Platform; or (v) use the Platform in any way not authorized by these Terms.

 

You may temporarily print, copy, download, or store the LoanOutlet.ca Content displayed on the Platform for Your personal use, provided that:

  • It is not used for commercial purposes and cannot be commercially exploited, published, distributed, extracted, reused, or reproduced without prior written consent from LoanOutlet.ca.

  • It is not sold or transferred to any third party.

  • Any copyright or intellectual property notices in the original material are retained.

  • The digital or printed copies of LoanOutlet.ca Content are not modified.

  • The Content cannot be excerpted, displayed, or used on any other website without prior written consent.

  • The authorship of ADC and its licensors must be acknowledged.

 

11. Feedback

By submitting any ideas, suggestions, comments, or feedback to LoanOutlet.ca regarding the Services (or any other product or service offered by LoanOutlet.ca) (collectively, "Feedback"), You agree that LoanOutlet.ca may freely use the Feedback for any purpose.

LoanOutlet.ca reserves the right to review, monitor, and/or remove any Feedback at its sole discretion and at any time, for any reason, without notice, including to comply with legal requirements or address any claim that the Feedback infringes upon the rights of third parties.

 

12. Communication

By using the Service, You acknowledge and agree that we may communicate with You via automated push notifications, email, SMS, direct messaging, or other electronic methods to provide marketing communications, special offers, and account updates. You can opt out of these communications by clicking the "Unsubscribe" link located in the footer of any email or electronic message we send.

 

13. Termination

LoanOutlet.ca may suspend or terminate Your access to the Platform or Services at any time, without notice, for any reason at its discretion, including but not limited to breach of these Terms, fraudulent activity, abuse of the Services, or violation of Applicable Law.   • Any inaccuracies, misrepresentations, or errors in Your User Documents.

 

You agree to promptly notify LoanOutlet.ca of any such claim, demand, or proceeding of which You become aware.

 

17. Exclusion of Liability for Service Partner Advice, Assistance, and Products

The Platform allows You to apply for various products and services provided by third-party lenders, not by LoanOutlet.ca. LoanOutlet.ca has no control over these third parties. It is solely Your responsibility to ensure You are satisfied with the products or services before proceeding. LoanOutlet.ca, and any applicable Referral Partner, are not responsible or liable for any loss or damage You may experience in connection with any product or service You obtain after using the Platform, or for any actions, omissions, errors, or defaults of third-party Service Partners related to those products or services.

 

Please note that the information and descriptions of products and services available on the Platform may not provide a full overview of their features, terms, and conditions. You are responsible for carefully reviewing all details, terms, and conditions of any product or service before applying.

 

If You choose to apply for and obtain a product or service, You will enter into a contract with the Service Partner offering that product or service under their specific terms and conditions. LoanOutlet.ca is not responsible for ensuring You understand or agree to those terms and conditions. It is Your obligation to confirm that You fully understand and accept the terms before proceeding. ADC is not liable for any loss or damage You may incur due to the terms of any contract You enter into with a third party or for any actions, omissions, errors, or defaults of that third party related to their terms and conditions.

 

The Platform may include links to third-party websites, including links in emails sent to You as part of LoanOutlet.ca's services. These websites are operated by independent third parties, and LoanOutlet.ca has no control over them. Accessing and using these third-party websites is entirely at Your own risk and discretion. Any disputes, claims, or legal proceedings arising from or related to the Platform or Services will fall under the exclusive jurisdiction of the Courts of Ontario.

These Terms do not create any agency, partnership, joint venture, or employment relationship, and You do not have the authority to bind LoanOutlet.ca in any way. Any waiver or consent provided by one party to the other regarding a breach must be in writing and does not constitute a waiver of future breaches unless explicitly stated. These Terms represent the entire agreement between You and LoanOutlet.ca concerning the subject matter and override any prior agreements or understandings. If any provision of these Terms is deemed invalid, illegal, or unenforceable, it will not affect the validity or enforceability of the remaining provisions, which will continue in full force and effect.
